Environmental group sues Yakima Clean Air Agency

YAKIMA, Wash. -- An environmental group is suing the Yakima Regional Clean Air Agency for refusing to provide electronic copies of emails related to a policy on reducing pollutant emissions from dairies.

The lawsuit, filed in December but served Wednesday, contends the agency has violated the state Public Records Act.

The lawsuit was filed by a group called Citizens for Sustainable Development, represented by attorney DeWelle Ellsworth of Seattle.

According to the complaint, the group in December 2010 sought electronic copies of all emails sent or received by the agency related to the dairy policy.

The complaint said agency Executive Director Gary Pruitt authorized the records to be viewed and copied at the agency's offices on North First Street, but refused to have them sent in electronic form.

Agency officials said they were reviewing the complaint Wednesday afternoon and had no comment.

The agency devised the voluntary dairy-emissions policy last year and tested it at 15 dairies through the end of 2011.

The policy describes practices dairies can use to reduce the amount of chemical compounds, dust and odors that escape from dairy operations.

Agency directors are scheduled to adopt the policy today.
