YAKIMA, Wash. -- Michele Taylor, the 31-year-old East Valley High School physical education teacher accused of having sex with a 16-year-old male student last spring, is appealing termination from her job.

Taylor has asked for a hearing, and that request "constitutes an appeal of the probable-cause letter for termination" that the East Valley School District sent her earlier this month, according to Seattle attorney Michael Patterson, who represents the school district.

The letter, sent Nov. 2, informed Taylor, who's been on paid leave since June, that the school district intends to end her contract. Taylor had 10 days from her receipt of the letter to decide whether she wants to appeal the decision.

Bremerton attorney Joe Evans, who works for the Washington Education Association and represents Taylor on personnel matters, declined to talk about the appeal.

"I can't talk to you about that," he said. "I represent her, but it's an administrative matter. It's a closed matter."

When district officials met with Taylor on Oct. 21, she denied the allegations against her, according to Patterson. After that meeting, district officials said they would further investigate the allegations and interview witnesses. And based on that investigation, they found probable cause to terminate her, according to Patterson.

The next step is for both sides to select and agree upon a hearing officer, who will weigh the evidence and determine whether there is indeed probable cause for Taylor's termination.

"We'd like to see it all happen within the next 30 days," Patterson said.

After a hearing, it can take about a week for a hearing officer to make a binding decision.

Taylor made her first appearance in Yakima County Superior Court on Oct. 16. She's charged with first-degree sexual misconduct for allegedly having sex with a 16-year-old male student in the back of her truck outside the Yakima Kmart store.

She's also charged with two counts of communicating with a minor for immoral purposes. Authorities allege she exchanged more than 400 text messages with the 16-year-old as well as a 15-year-old student between March and June.

Ulvar Klein is her criminal defense attorney.

Taylor has taught P.E. at East Valley High School since 2004. Her husband, Kevin Taylor, is also a P.E. teacher in the district.

The criminal trial scheduled to begin Dec. 21.

What is this about East Valley, the physical education department and "alleged" predators? Remember Mr. Painter a few years ago from East Valley?

I'd like to know what the supposed probable cause is. Kids making up some fantasy about an attractive young teacher is enough to fire her? Look at her; she's beautiful, energetic, fun, and in great physical shape. I am sure many high school boys have fantasized about her. I know that Mrs. Taylor always takes extra time to help her students when they need it. Her volleyball players adored her because she took the time to get to know the girls and listen if they needed to talk. Kids need that!

I think that everyone also needs to look at the character of the boys versus the character of Mrs. Taylor. The boys have been in trouble for numberous things and aren't well respected at EV. On the other hand, Mrs. Taylor graduated from EVHS with very good grades, a very good reputation, was a great athlete, and all her former teachers and coaches have nothing but good things to say about her. They all would agree that she is a 'by the books' kind of person, always following the rules. In college, she was the same way - good grades, excelled in sports, and very well respected. As a teacher, her colleagues have nothing but positive things to say about her.

It just breaks my heart to see this wonderful family, who has given so much to this community, be treated this way just because a couple of boys decide that they want to ruin her life even after she tried to help them. What a shame!

Well, at least wimpi's comments and links stayed on for four hours so most everyone got them. I know her and I can and have looked at the files. She's really got it in for this Sheriff Ken Irwin and I guess she's planning on started a big web site about him and one other department . I thought it was on topic. People are getting so narrow minded. Or is most of the crying being done by Ken Irwin? Perenially, grinning, grinning Irwin? Good grief, let me hear it all at once and get it over with.

It is well understood that with an adult and a minor, the minor is always right in these matters and the adult is always guilty until proven innocent. Just take a domestic disturbance as an example, the husband is always arrested and then the statments are taken from the wife. It is found that she lied, oh well, apologize and let him try to put his life back together.

I sympathize with her and her family but withhold my judgements in the matter until the facts are all out.

Go to the link wimpi posted on Yakima Foster Children. It's a cartoon about an illegal center that could possible churn out kids able to do this. Most definatly. I guess Sheriff Irwin got mad at her because his map he's got to keep had so many mistakes and many of the creeps were right around where this place is. He's not gonna be very happy when she starts her web site. He can't shut that down. What an immature person and not very capable either. But she will give me her cartoons and I can post them. Then she told me to take a screen capture so that we can have proof that it's probably Irwin behind it. Irwin's official county web site was advertising this place as a legal daycare. Wimpi said she has incontrovertable screen captures showing mistakes all over of the level three offenders all aroung this place. When it becomes obvious that Irwin's harrassing her she can go the the state Sheriff's Assoc. I guess it took her a week to do it and she said the county was recoding their HTML but it doesn't matter. Maybe this is why Irwin's aged so much since he became Sheriff.
Patty Murray is the one keeping the money from the good places and letting it continue for these terrible ones. But why would the Sheriff get involved?

Will I get kick off for posting links? They're not even on this site. In Seattle there's all kinds of cartoons right on the blogs.

Are you kidding me! Just because she was good at school and goes to church has nothing to do her character. Church is not a good example of a good person. All the peds that work at the church would not be a good defense for her. She is guilty until proven innocent and if she was a man no one would even give a crap.

I agree with Yakima4life....going to church or being a good student does not mean she isn't capable of making a wrong choice, or doing something bad. If she didn't do anything wrong then she has nothing to worry about. We don't seem to give men the same consideration in this area as women, which is plain and simple... a double standard. It will all play out in court and we will find out if she is innocent or not. Also... saying the boys weren't exactly great kids is irrelevent in my opinion....she's the "adult" and they are the "children".

Maybe the Patty Murray old hags group they've got here churning out severely mental kids liked her and she didn't like them, get it? Since most of them are in the huge beaurocracy of the "Yakima's Mental System" and seem to be more inclined to harm rather than "do know harm", they will make her a nervous wreck by the time she goes to court.

I wish wimpi was still online. I just don't see why they would kick her off because of a cartoon. Her angle was always kind of refreshing, if you ask me.

Why is 'saying the boys aren't exactly great kids' irrelevant? So what if the kids had a great reputation and the teacher had a bad one. Would that be relevant? Of course it would! Her character and prior reputation have to be taken into consideration, as it should for the accusors. Prior behavior patterns often predict future behavior, so if Mrs. Taylor has always been a 'by the books' type of person, I think that she will probably continue to be. If the accusors have always been jerks or mentally unstable or very sexual, then I think they will likely continue to be. Therefor, it gives us a good indication that the boys are acting like jerks and making this up and Mrs. Taylor is innocent!

When you said that 'she's the adult and they are the children' what do you mean? Why should a kid's bad reputation and a teacher's good repuation not count?

I think being 'over fifty' has caused you to not think about this situation clearly.

I didn't say her reputation didn't count. When accusations like this happen.. "in my opinion"...we must always assume the children are telling the truth. Kids should always come first. If she did nothing wrong, she has nothing to worry about. It will all play out in court. I didn't say I thought she was guilty, I was commenting more on the double standard when men get accused of the same thing.

P.S...overfifty is still young!

Exchanging 400 text messages with someone half your age isn't a crime. It's just wrong in my opinion but I personally don't believe it's enough to get her fired and convicted of a crime though. The subject of the texts are what they're looking at, not the volume of texts(I hope that's obvious). If they're in any way suggestive then, yes, there would be grounds for her termination and conviction. If not I certainly hope she is in some way reprimanded for being careless and I hope she learns her lesson. Like everyone else has said, if she didn't do anything wrong then she has nothing to worry about and given that she isn't afraid to take a stand gives me hope that she is innocent of her charges.

Good thing we have jury trials in this country, after listening to all of the above. Just two things from me. First, it seems irrefutable as peapicker said, that the PE teacher "takes extra time to help her students." And finally, since when does a criminal defendant get exonerated by dint of being a churchgoer? I thought people went to church in the first place, because they acknowledge themselves to be immoral sinners?

You said that if she didn't do anything wrong, she has nothing to worry about. Uh, easier said than done. Let's just agree for a second that she didn't do anything wrong (I don't think she did). She has to 'worry' about whether a jury will believe her or the kids. She has to 'worry' if the school district will believe her over the kids. She has to 'worry' about the effect all of this is having on her own triplets. She has to 'worry' about how this is affecting her husband and family. If she gets her job back, she has to 'worry' about how everyone is going to act around her at school. When she is in town, she has to 'worry' about what others think of her. If she chooses to find another job, she has to 'worry' about whether they will hire her or not. When she is found innocent, she has to 'worry' about whether everyone thinks she is really innocent. So not worrying because she is innocent is practically impossible to do!

To RWBSocks - I said nothing about going to church when I was talking about her character. I was simply stating that her past patterns of behavior have all been positive so I think that it is an indication of her character. Also, the past patterns of behavior for the accusors have been negative so I think that is an indication of their characters as well.

I think the question needs to be asked.What policy's does the school dist. have in place when it comes to teachers contacting students outside the classroom.All school's say teachers go thru training every year on appropriate teacher/student contact.What does this training have to say about text messaging students or contacting them online?Does it give teachers any procedures to follow if they feel they need to contact students outside the classroom?

I understand what you are saying. Heres how I look at things....(my way of thinking)... If I've NEVER texed another man while being married, I will NEVER have to worry about being accused of cheating. My phone texts will "prove" this. You make it sound like all of these accusations against this teacher just fell out of the sky and landed in her lap. When people "truely" live their lives "by the book"(your words)...they rarely, if ever, get accused of such things. Just my way of thinking. It will all play out in court.
